تعد دراسة النظام القضائي من الدراسات المهمة، كون القضاء هو ركن من اركان اقامة الدين والعدل بين الناس، وان مفهوم النزاهة القضائية في الشريعة الإسلامية قيمة أخلاقية تجمع في طياتها صفات عدة، مثل الاستقامة والصدق والأمانة والعفة ونقاء السريرة. وبالمقابل فإنها تتجلى في البعد عن المفاسد ومواطن الشبهات، أما في مجال العمل القضائي فتعد النزاهة أكثر من كونها فضيلة، لأنها في حقيقة الأمر ضرورة وشرط أساسي لتولى الوظيفة، لذلك يجب على القاضي أن يتأكد من أن سلوكه على المستويين الشخصي والمهني فوق مستوى الشبهات، واضعا في الاعتبار أن سلوك القاضي الشخصي يؤثر في صورة المنظومة القضائية كلها في أعين الناس، وبعبارة أخرى يمكن القول إن النزاهة تدعم ثقة المتقاضين في حياد وموضوعية قاضيهم.
وسوف نسلط الضوء في هذه الدراسة على الاسلوب النقدي عند تقي الدين المقريزي(ت845هـ/1441 م) في ابراز واظهار نزاهة القضاة في عصر طغى عليه الفساد الاداري والسياسي والقضائي، وبهذا تم تقسيم البحث الى ثلاث محاور، جاء في المحور الاول وصف حالة المؤسسة القضائية في عصر المماليك لكي نعطي صورة واضحة لما تعانيه المؤسسة من تدهور وتدخل سياسي في تلك الفترة، اما المحور الثاني فهو الجانب الاساسي من البحث حيث تطرقت فيه الالتزام بالعدالة ومنع التدخل في القضاء، وجاء المحور الثالث هو الالتزام بالقيم والاخلاق، كونها تعد ظاهرة نادرة في ذلك العصر.
