Abstract

Based on the need to provide a legal and social framework that respects and protects the humanity of the elderly and to create an international and national environment that ensures a society for all ages. This group should receive the attention required, especially in the light of the international development of the rights of the elderly, It was necessary to review the legal reality of the elderly in Iraq, to ​​uncover the basic trends of this reality, and then find out the compatibility with the international obligations of Iraq to the elderly, and reflect on the new directions to be taken, as long as it is necessary, And the rules of public international law require the recognition of the legal personality of the human being as a fundamental right to be associated with it, which begins with his life and ends with his death. The Universal Declaration of Human Rights Of 1798 states that "Every person, wherever he may be, has the right to be recognized as a juridical person."
